著作権について

・著作権とは

　著作権とは著作物を保護の対象として、著作権法という法律により認められた権利です。

・著作物とは

　著作物とは、思想、感情を創作的に表現した、文芸、学術、美術、音楽の
　範囲に属するものです。それを創作した人が著作者です。
　著作物は、創作した時点で自動的に権利が発生し（無方式主義）、
　保護されます。
　うまい、へたにかかわらず、思想や感情が創作的に表現されていれば、
　子供が描いた絵や作文も立派な著作物です。

・著作者の権利には

　著作者の権利には、著作者の人格的権利を保護する『著作者人格権』と、
　著作物を利用し利益を得る『著作権』（財産権）の二つの権利があります。
　『著作者人格権』には　
　　［公表権、氏名表示権、同一性保持権］
　『著作権』（財産権）には
　　［複製権、上演権及び演奏権、上映権、公衆送信権等、口述権、
　　　展示権、頒布権、譲渡権、貸与権、翻訳権・翻案権等、
　　　二次的著作物の利用に関する現著作者の権利］があります。

　今、ここでは著作権法の内容について詳しく述べられませんので、

・デジタル社会の著作権

　インターネットなどの飛躍的な発展により、今はコピーが簡単に、しかも大量にできてしまい、
　絵を描いた私達作者の知らないところで複製されてしまう場合も考えられます。
　自分のものではない絵や文章などをホームページにのせたりする場合は、
　必ず作者の許可が必要です。
　尚、家庭内などでの私的な使用のための複製、図書館における複製、
　教科用図書などへの掲載、学校その他の教育機関における複製、などは
　著作権法で自由利用が認められています。
　ただし、その場合でも著作者人格権は保護されていますし、
　色々な制限がありますので注意が必要です。

　ホームページでの複製利用は私的使用にはなりません。
　個人のサイトに著作者の作品が無断で掲載されていた例があります。（模写も含みます）
　これは著作権法上の「複製権」(コピー)、「公衆送信権・送信可能化権」、
　「著作者人格権」を侵す行為です。
　著作権法違反は民事上の損害賠償や、刑事罰も科せられる犯罪ですので、
　削除の警告をしてもなお掲載が続いている場合は法的に対処されることもあります。

・What Is "Copyright"?
Copyright is the right to protect works of authorship, provided for in the Copyright Law.

・What Is "Work"?
A "work" is production of man in which ideas, thoughts or sentiments are expressed in a creative way,
in literary, scientific, artistic or musical domains, and the creator is called the "author".
Copyrights are conferred upon the author with the creation of a work, without the need for registration
(non-formality rule).
A drawing by a child is also a work with full protection if it is an expression with thoughts or sentiments,
regardless of its merit.

・What Rights Are Granted to Authors?
Author's rights are divided into two categories: "Moral Rights" to protect an author's moral/emotional
interests and "Property Rights" (Economic Rights) to protect an author's economic interests.
Moral Rights include Right for Divulgence, Right for Authorship and Right for Integrity.
Property Rights include Right of Reproduction, Right of Public Performance, Right of Public Display,
Right of Public Transmission, Right of Public Recitation, Right of Public Exhibition, Right of Distribution,
Right of Transfer of Ownership, Right of Public Rental, Right of Adaptation and Right of Exploitation of
Derivative Works.

・Copyrights In the Digitalized Society
With the drastic advancement and diversification of information technology including the Internet,
it is so easy to copy another person's works in large quantities now. Your works may be reproduced
without your knowledge.
A person who wants to download another person's pictures or writing in his/her Website must obtain
authorization to exploit the works from the author.
The Copyright Law stipulates some exceptional cases in which copyright is limited and works can be
exploited without authorization such as:
● Reproduction by user himself/herself for the purpose of his/her own personal use, family use or
　　other similar uses within a limited circle;
● Reproduction in libraries;
● Reproduction in school textbooks;
● Reproduction for teaching materials at educational institutions, etc.
　　However, even in the above-mentioned cases, strict conditions are provided, and the limitation of
　　economic rights does not mean limitation on moral rights.

・Downloading of a work for a Website is not deemed to be private use.
There have been some examples of downloading or duplication of a work for a personal Website without
the author's permission. These are acts of infringement of "Right of Reproduction", "Right of Public
Transmission" and "Moral Right".
Violation of Copyright Law is subject to crime with damages or penal sanctions, unless the Website owner
deletes the work from the Website after the warning, he/she may be dealt with by the law.
